Verlin - my understanding is that you would still be liable. It is the intellectual property that is protected. They are not required to sell to all areas, although I don't understand why they won't sell to Canada. However, since they don't want to sell to Canada, I would ask them for a letter giving you permission to work with the ideas in the plan for your client. If you can get that in writing, then you are clear as you will have their permissions.

Verin I agree with Tim. They still own the copyright. I would contact them and ask them if you can pay a fee for the use of the design with the understanding that you will build only one house, you will develop all the construction documents, and you would not hold them liable for anything. If I was them, I would go for that.
